Ghandy filed the petition through his counsel Redecca M. John, citing a Supreme Court case where it is said that consent of a person is necessary before he undergoes narco test.
The petition is likely to be heard Thursday.
The trial court had Oct 31 allowed narco test on Ghandy after a panel of doctors from the All India Institute of Medical Sciences (AIIMS) told the court that Ghandy is fit for the test.
He was arrested Sep 21 and is in judicial custody.
