63-yr-old assaulted by housing society chairman for pointing out leaks in Malad flat

Though an FIR was lodged a month ago, the complainant claims police action is still awaited; the accused, who also allegedly put a gun to the victim's head, says the latter is a troublemaker, and he actually slipped and fell on the day

Even previously, we have brought you stories of cooperative housing societies in the city and their uncooperative members. But, the chairman of a particular apartment complex in Malad seems to have actually jumped the gun, literally. The matter was brought to the notice of the police by 63-year-old Chandu Tulsidas Pahuja, a resident of Atlanta CHS, Evershine Nagar, who was allegedly threatened at gunpoint and assaulted by the accused for making ‘frivolous’ complaints. The victim claims the battering landed him in hospital for two days. MiD DAY is in possession of a copy of the FIR, where the chairman, Narendra Singh Kaler, has been charged under sections pertaining to voluntarily causing grievous injury. But nearly a month after the incident, Pahuja alleges, action from the police is still awaited.

‘Bug off’
“It was around 9 am. I was chatting with the society manager Sawant in the complex’s office and waiting for some workers, who were expected to carry out pest control applications in my flat. This is when the chairman barged in, and using expletives, accused me of turning the building into a dustbin with my written complaints about my leaky roof,” the victim said. Pahuja also alleged that, without warning, the chairman then picked up a wooden stick and starting hitting him on his head, knees and shoulders. Not satisfied, Kaler then went on to punch him in the face, causing injuries to his nose and an eye.

“When I tried to call the cops, Kaler threatened me of dire consequences and kept boasting of his police connections. Next, in very filmy style, he pulled out a revolver, which he always carries on his person, and put it to my head, threatening: ‘Aaj tujhe jaan se mar dalta hun. Tumhe jisko phone lagana hai use phone lagao, police mera kuch bigad nahi sakti (I will kill you today. Call anyone you want to, cops can’t touch me)’,” Pahuja said. The victim says he was subsequently admitted to Ameya hospital, Goregaon, for two days, and an FIR was lodged at Bangur Nagar police station. “My grievance is that cops have not added sections under the Arms Act, nor has the accused been arrested,” Pahuja told MiD DAY.

The other side
When contacted, police inspector Anil Walzade, who is the investigating officer, stated that he has just been handed the case two days ago and a fact-finding probe is on. “It is apparent that there are a great deal of internal problems between members of the society. We will complete our investigations and then it is up to the courts to decide further outcome of the case,” he said. Narendra Singh Kaler completely rejected the allegations made by Pahuja and deemed him a troublemaker, who keeps making false complaints against society members with the police and the BMC for the smallest of reasons. “On that particular day, Pahuja actually slipped and fell on his own and then made a big issue out of it by filing a complaint with the police, alleging that he was beaten up. He is a known troublemaker, notorious for his cunning and deceptive behaviour,” claimed Kaler. Kaler added that he has been the housing society chairman for the last one year, but Pahuja, in the past, had also given a tough time to former committee members and even assaulted one of them with a stone, for which a police complaint had been made.u00a0
