Bombay HC tells Mumbai civic body: ‘Show us you can crack down on hawkers’

The Bombay High Court, while hearing a suo motu PIL on Wednesday, on the issue of illegal hawking increasing in the city, directed the Brihanmumbai Municipal Corporation (BMC) to evict such vendors from the stretch between Chhatrapati Shivaji Maharaj Terminus (CSMT) and Flora Fountain and monitor the situation for two weeks.  If the civic body’s efforts prove successful, they can be replicated across the city, the court stated. The court also ordered the additional commissioner of police concerned to ensure armed police protection was provided to civic officials while they got rid of the hawkers. The PIL was heard by a division bench comprising Justice A S Gadkari and Justice Kamal Khata. During the hearing, the court emphasised that the removal of hawkers should be a continuous process, stating, “The BMC must remove them repeatedly if they return.” The bench was critical of the civic body's previous efforts. Justice Gadkari passing a comment said, “Officials are intentionally ignoring earlier directives or failing to understand simple instructions… Tell us bluntly, how many hawkers do you want to protect or hawkers from which area do you want to protect?” Before breaking for lunch, the court directed the BMC officers present to inspect the stretch between CSMT and Flora Fountain and submit a report on whether they were following the court's earlier orders concerning the removal of hawkers. Civic officials crack down on hawkers on D N Road following the high court’s orders Justice Gadkari stated, “This is complete lawlessness. Despite multiple orders passed by the court and replies filed by the state agencies, the ultimate result is that the hawkers are still on the spot. The BMC is unable to control hawkers. Pedestrians have the right to walk on the footpaths. The BMC has not complied with our orders time and again.” A few hours later… Shortly after the high court issued the orders, the BMC swung into action, seizing goods of hawkers who lacked licences. Initially, they were accompanied by police officers, but after some time the latter were seen leaving the civic officials to their own devices, in violation of the court’s orders. Police officers who accompanied civic officials during the crackdown. Pics/Atul Kamble Parikshak Patil, an official from the BMC’s encroachment department was heard requesting police officers to stay. In response to this, a police officer said he had somewhere else to be. Speaking in Marathi, the official said, “Tumhi tumchi karvayi kara, amhi amchi karvayi karayla jato [You do what you have to do, we are going to do what we have to do].” Patil, the civic official, said, “I was present during the hearing on Wednesday and heard each and every word the judges said. That’s why we requested the police officers to stay until our task was completed, but they left.” At some locations, hawkers were seen showing licenses issued by the BMC licensing department. The BMC officials seized some goods from some of these hawkers while leaving others untouched. Explaining this, Patil said, “We cannot seize all the goods of licensed hawkers. These vendors are allowed to put up a 1x1-metre stall. We have seized whatever goods were outside this permitted space. Today, the licensing department officials will visit these stalls to check their licence again and issue an IR (inspection report). If the stall is found to be bigger than the area permitted, action will be taken against the stall owner." During the hearing when the BMC counsel had raised the point of licensed hawkers, the bench stated, “We said not a single unlicensed hawker should be seen on the decided stretch. We have not passed any directives about licensed hawkers. Whatever and whoever is illegal should go.” Oct 23Day hearing was held

Maharashtra is openly being looted," he alleged. According to the report, on Wednesday, the MVA, which includes the Congress, Shiv Sena (Uddhav Balasaheb Thackeray group), and the Nationalist Congress Party (Sharad Pawar faction), unveiled their seat-sharing formula. Each party will compete for 85 of the 255 seats, with the remaining 23 seats selected by party candidates. Some of these seats will go to allies like the Samajwadi Party, PWP, and CPI. Kedhar Dighe, nephew of late Shiv Sena leader Anand Dighe, will face Chief Minister Eknath Shinde in the Kopri-Pachpakhadi constituency. Anand Dighe had mentored Shinde, the report stated.  Ajit Pawar's Nationalist Congress Party (NCP) has released its initial list of 38 candidates, with Deputy Chief Minister and NCP President Ajit Pawar running for the Baramati constituency. Mahim assembly seat at high stakes among the Sena parties in the upcoming polls

The esteemed Mahim assembly seat in Mumbai is at high stakes in this year's Maharashtra elections as it sees competition among  the ruling Shiv Sena, the opposition Shiv Sena (UBT) and the Raj Thackeray-led Maharashtra Navnirman Sena (MNS), PTI reported. Mahim has witnessed the birth of the undivided Shiv Sena in the year 1966 and then MNS in 2006 when Raj Thackeray launched his own independent political party. According to PTI, Raj Thackerya's son Amit Thackeray is set to make his electoral debut from the Mahim seat, which is among the 26 assembly segments in Mumbai. The Shiv Sena, led by the Chief Minister of Maharashtra Eknath Shinde, has fielded sitting MLA Sada Sarvankar from Mahim, while Mahesh Sawant from Sena (UBT) will contest from this seat, PTI reported. When PTI on Wednesday asked Shiv Sena (UBT) leader Sanjay Raut about the party would run a candidate against Amit Thackeray, he said that the since the Sena was founded in the Mahim-Dadar belt and it is not possible that it will not contest the seat. MNS founder Raj Thackeray and Shiv Sena (UBT) president Uddhav Thackeray are cousins. Uddhav Thackeray's son Aaditya Thackeray is the MLA from Mumbai's Worli assembly seat and is seeking re-election from the seat in the upcoming elections, PTI cited. The Shiv Sena went through a spilt in June 2022, when a section of the MLAs, led by Eknath Shinde rebelled against the then-chief minister of Maharashtra, Uddhav Thackeray. As per PTI, Mahim has a mix of predominant upper-class Maharashtrians, fairly large cosmopolitan population and minority voters. The Uddhav Thackeray led - Shiv Sena has its headquarters in Mahim. The area also has the MNS headquarters. The famous Shivaji Park ground is also located nearby Dadar where both MNS and Sena (UBT)  host their yearly Padwa and Dussehra rallies, respectively. The Mahim constituency has always been with the undivided Shiv Sena or the MNS since 1990. In 2009, MNS candidate Nitin Sardesai won the Mahim seat. Elections for the 288-assembly seats of Maharashtra is scheduled to be held on November 20, with vote counting on November 23, PTI reported.

Maharashtra Elections 2024: Ajit Pawar nominates most MLAs, keeps some waiting

Nationalists Congress Party’s Ajit Pawar faction has kept some of its sitting MLAs, including the city legislator Nawab Malik, waiting while announcing a list of 38 candidates for the Assembly elections on Wednesday. It gave poll tickets to imports from the Bharatiya Janata Party and Congress and also fielded some new faces.  The party is expecting 55-60 seats in sharing with the BJP and Shiv Sena (Shinde) who have also released their first list. BJP’s 99 came on Sunday night and Sena’s on Tuesday night. The Maharashtra Navnirman Sena has also declared 45 nominees, including the party president’s son Amit from Mahim. Ajit from Baramati Putting speculations to end that he would change his constituency, Ajit Pawar chose a battle in Baramati, his forte, where he is expected to be opposed by his nephew Yugendra Pawar. Ajit’s all cabinet colleagues—Chhagan Bhujbal (Yeola), Dilip Walse-Patil (Ambegaon), Hasan Mushrif (Kagal), Dhananjay Munde (Parali), Dharmarao Baba Atram (Aheri), Aditi Tatkare (Shrivardhan), Anil Bhaidas Patil (Amalner) and Sanjay Bansode (Udgir), along with deputy speaker Narhari Zirwal (Dindori) were nominated. Former BJP minister, Rajkumar Badole, who joined the NCP on Tuesday in a special arrangement with his original party, will contest from Arjuni Morgaon. The NCP denied its sitting MLA, Manohar Chandrikapure, re-nomination. Imports from Congress, Hiraman Khoskar (Igatpuri) and Sulbha Khodke (Amravati) will be fighting on NCP’s ticket to retain their respective seats. Khodke, originally an NCP leader, had fought as a Congress nominee because of the 2019 seat-sharing formula that gave her constituency to the ally. Bharat Gavit (Navapur) and Nirmala Vitekar (Pathri) will be the new faces. Awhad vs ex-mentee In Thane’s Kalwa-Mumbra, the Sharad Pawar faction’s senior MLA and former minister, Jitendra Awhad, has been challenged by his estranged mentee Najeeb Mulla. Awhad once mentored the former Thane corporator. After the party’s split, Mulla stayed with Ajit Pawar. In the past 15 years, Awhad has enjoyed majority support from the Muslim-dominated Mumbra.  In waiting      Mumbai’s Anushakti Nagar MLA Nawab Malik is among the legislators sitting and waiting for the party to nod. Malik’s candidature has been opposed by the BJP. Malik’s daughter Sana is expected to get nominated in the father’s seat. It is also said that Malik will shift to Mankhurd-Shivaji Nagar constituency where Samajwadi Party’s Abu Azmi has reigned supreme since 2009. Other MLAs, whose decision is pending are—a six-term MLA from Madha, Baban Shinde, his brother Sanjaymama Shinde (independent from Karmala), Balasaheb Ajabe (Ashti), Devendra Bhuyar (Morshi), and Sunil Tingre (Vadgaon Sheri). MLAs Dipak Chavan (Phaltan) and Rajendra Shingne (Sindkhed Raja) have defected to the Sharad Pawar faction. Their replacements have not been announced.
